These Terms of Service ("Terms") govern your use of gotierneymedia.com (the "Site"), operated by Tierney Commerce, LLC d/b/a Tierney Media Enterprises ("TME," "we," "us"). By using the Site, you agree to these Terms.

Services

TME provides marketing, advertising management, website, CRM, and lead-handling services to businesses. Client engagements are governed by a separate written client agreement. If that agreement conflicts with these Terms, the client agreement controls.

Pricing & Payments

Pricing shown on the Site is a summary and may change. Fees, minimum ad spend, revenue share, and payment terms for clients are set in the signed client agreement. Advertising spend is paid by the client directly to advertising platforms. Payments may be processed by third parties such as Stripe, subject to their terms.

No Guarantee of Results

Any examples, calculators, or projections on the Site are illustrative only. We do not guarantee any specific number of leads, calls, jobs, revenue, rankings, or return on ad spend.

Acceptable Use

You agree not to misuse the Site, interfere with its operation, attempt unauthorized access, or use it for unlawful purposes.

Intellectual Property

The Site's content, logos, and design are owned by TME or its licensors and may not be used without permission.

Third-Party Links & Services

The Site links to third-party services (such as Calendly). We are not responsible for their content or practices.

Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TME WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM YOUR USE OF THE SITE.

Indemnification

You agree to indemnify and hold TME harmless from claims arising out of your misuse of the Site or violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Venue lies in the state or federal courts located in Broward County, Florida.

Changes

We may update these Terms by posting a revised version on the Site.
